Poste 1 : Transitional Justice Specialist

BACKGROUND

The insurgency driven conflict in the Lake Chad Basin, including Northeast of Nigeria has been longstanding and has caused undesirable consequences in terms of loss of lives, created multi-tiered intergenerational grievances, destroyed socio-cultural and socio-economic systems, and remains a threat to immediate, medium and long-term transformation of the affected territories in Nigeria, including Borno, Adamawa and Yobe States. Borno has seen a significantly higher impact and the insurgency there has gone through a variety of phases and is marked by cycles that are connected with several factors.

By 2021 and into 2022, the insurgency in Northeast of Nigeria had taken an unprecedented turn leading to large number of individuals exiting the conflict and presenting themselves to security authorities, largely in Borno State, but also in neighboring countries. Moreover, sustaining this momentum of exits presents challenges to effective process of their handling and in treatment of the individuals as is led by government authorities and in ensuring their reintegration into communities amidst an ongoing conflict, an internal displacement situation and significant intergenerational grievances stemming from the longstanding conflict.

As a response to the mass exits, in November 2021, the State Government of Borno, passed a “Policy on Community-Based Reconciliation and Reintegration” premised on the Vision for long term transformation of the State to contribute to peace and stability. Additionally, the Borno State Government has developed and is implementing the ‘Borno Model’. This is a state-led programme for integrated management of those that have exited the insurgency and includes key community level interventions aligned with the CBRR approach on a community-oriented reintegration process while at the same time incorporating targeted reconciliation, healing, and long-term transformation perspectives. It is also aligned with the regional priorities under the Regional Stabilization Strategy for the Lake Chad Basin.

UNDP is supporting the Federal and State Government to make operational these approaches as aligned with implementation of the Regional Stabilisation Facility – Nigeria window, which is operating in some of the locations that have been identified for reintegration. This at the same time supporting alignment with the national/international principles and UNDP policy orientations for effective implementation of community-based reconciliation and reintegration.

Position Purpose:

Against the above background, UNDP seeks to recruit a Transitional Justice Specialist to provide technical advisory services and capacity building, regular and integrated analysis on transitional justice and human rights mechanisms and issues that informs the reintegration and reconciliation agenda.

DUTIES & RESPONSIBILITIES

Under the direct supervision of the Programme Specialist and Chief Technical Advisor Rule of Law and Human Rights, the Transitional Justice Specialist provides advice and technical support:

  • Advise the stakeholders in establishing sustainable mechanisms for transitional justice mechanisms and processes;
  • Advise the stakeholders on policies, strategies, systems, methods of management and training needs of human rights actors and stakeholders in the transitional justice area;
  • Liaise with the programme specialist and other members of the team to provide overall technical guidance on matters of government policy on transitional justice and coordinate with Rule of Law Specialists to implement these issues with the states;
  • Put in place strategies and systems for effective human rights promotion and protection, and inclusive transitional justice;
  • Collect and issue updates on activities on transitional justice including changes in legislation and national or regional strategies or action plans.

The Transitional Justice Specialist will provide Capacity building of state level stakeholders:

  • Support national institutions to develop and implement strategies, systems and action plans for the establishment of effective and representative transitional justice mechanisms;
  • Support the development and practice of promoting a focus on vulnerable groups, communities and victims in transitional justice processes and mechanisms;
  • Develop and implement capacity building strategies to meet the capacity and training needs of the state institutions involved in transitional justice and transitional justice mechanisms themselves;
  • Support community-based organizations and groups, state government, traditional authorities and vulnerable groups to participate, engage in and benefit from transitional justice processes and mechanisms;
  • Promote skills for mainstreaming gender, applying a human rights-based approach and support to vulnerable groups into reform priorities of and services provided by transitional justice mechanisms;
  • Coordinate and manage implementation of capacity building support to transitional justice;
  • Identify and support initiatives for victim support to advise, empower and facilitate victims groups to participate and benefit from transitional justice processes and mechanisms;
  • Organize and/or conduct transitional justice trainings and public information activities.

Providing Support to programme planning and implementation:

  • Provide substantial inputs to programme planning, implementation and monitoring, including drafting of relevant documents such as memos, briefs, talking points, meeting debriefs, minutes;
  • Develop detailed Annual Work Plans for the transitional justice initiatives together with the Specialists deployed at state level, and provide inputs to develop the consolidated Program Annual Work Plans;
  • Support development of ToRs for Small Grants, oversee the work of beneficiaries of Small Grants Facility, and ensure quality of outputs in keeping with grants applications;
  • Ensure programme work plans in the state are implemented and supervise UNDP supported work undertaken in the state as required;
  • Submit quarterly analytical reports and provide inputs into other reporting requirements to the donor and M&E activities in the transitional justice area to the Programme Manager on work done and further prospects as decided by the program;
  • Support the programme management to develop necessary documentation (concept notes, briefs, and fundraising notes) to operationalize and steer programmatic initiatives and activities.

The Transitional Justice Specialist will provide Facilitation of the strategic partnerships that promotes UNDP mandate and corporate policy and provides senior high level policy advice to government and other partners:

  • Develop strong working relationships with national and state stakeholders, traditional justice institutions, CSOs and international partners;
  • Liaise with partners and facilitate communication on Program-related activities including organizing joint thematic learning and networking events on transitional justice topics;
  • Develop and maintain close working relationships with civil society and community groups to facilitate project implementation, as well as identify issues, risks, priorities, and opportunities that support effective programme implementation;
  • Liaise with and establish strong working relationships with other UN agencies and international organizations to promote a coordinated approach to the development and implementation of transitional justice activities.

The Transitional Justice Specialist ensures knowledge building and management focusing on achievement of the following results:

  • Collect monitoring data on a regular basis and issue updates on activities in the transitional justice area including changes in legislation and national or regional strategies or action plans;
  • Monitor the key interventions of the Programme on transitional justice particularly for vulnerable groups such as victims of past abuses, IDPs, children, the elderly, and survivors of SGBV;
  • Monitor and report on transitional justice issues locally, and identify emerging trends using program mapping and other available data;
  • Communicate results based on corporate principles of gender-responsive communications and non-discriminatory language.
  • Promote cross-network initiatives and support collaboration of cross-regional programming priorities within knowledge networks and communities of practice

Supervisory/Managerial Responsibilities:

  • The Transitional Justice Specialist supervises project staff determined under the component’s programme portfolio. People Management is required competency for this assignment. The incumbent should aspire to create an enabling workplace, manage performance and ensure accountability, building capability of the team, motivating and directing the team to work towards a common vision and goal that is shared by the Country office and other related components of the sub office work.

RECRUITMENT QUALIFICATIONS

Education

  • Master’s Degree or equivalent preferably in Law, International Law, International Human Rights Law, Governance, Peacebuilding and Conflict Prevention, or related discipline.
  • Bachelors degree in combination with 2 additional years of qualifying experience may be accepted in lieu of the Masters degree.

Experience

  • Minimum 7 years (Master’s degree) or 9 years (Bachelor’s degree) of relevant experience working on transitional justice;
  • Demonstrable experience in UN’s work in terms of transitional justice and/or human rights practices in fragile environments;
  • Preferred experience working in rule of law, human rights and transitional justice within the region;
  • Excellent analytical and drafting skills is required;
  • Demonstrable experience working on / with community-based reconciliation and reintegration processes;
  • Experience in mainstreaming gender into programme and project implementation is an asset.
  • Experience managing grants for CSO’s, or other relevant stakeholders is an asset;

Language Requirements

  • Proficiency in oral and written English.

UNDP Country Programme Document 2020-2024 aims at supporting the Government of the DRC in its efforts to eradicate extreme poverty in all its forms and to reduce inequalities and the vulnerability of the population. To this end, an integrated approach to three main priorities has been adopted: (1) promotion of governance: which aims to improve the legal and institutional environment necessary to strengthen the inclusion of target populations in decision-making and promote their well-being; (2) economic transformation: which aims to support the achievement of a structural transformation towards a sustainable and inclusive green economy using a human development approach; and (3) stabilization and resilience: which targets support to fragile and conflict-affected regions through a comprehensive and integrated package of support.

As part of its programmatic pillar on stabilization, conflict prevention and resilience, UNDP contributes to the ISSSS through a close collaboration with MONUSCO’s Stabilization Support Unit and by contributing to the ISSSS 2020-2024 strategy which focuses on the three Eastern provinces (North Kivu, South Kivu and Ituri) throughout the implementation of its Stabilization and Resilience offer. UNDP is also co-leading support the MONUSCO transition and in line with the Humanitarian, Development and Peace Nexus. To operationalize this contribution, a joint UN programme on Peace and Stabilization is under development, where UNDP, MONUSCO and other UN AFPs join forces in delivering peace and stabilization benefits to communities and reinforce the leadership and capacities of the governmental institutions throughout the MONUSCO transition.

In accordance with its programmatic approach to governance in the DRC as articulated in the CPD, UNDP efforts is founded on the premise that sound governance policies, institutions and practices are essential for sustainable and inclusive development. UNDP focuses on supporting democratic institutions, citizen participation, and decentralization by (i) creating conditions for increased national ownership of the electoral process; (ii) enhanced parliamentary strengthening and improved citizen engagement; (iii) increased decentralization and local development through the equitable participation of men and women in the decision-making and related processes, as well as strengthened capacity of decentralized territorial entities for a reasonably effective and efficient public service managementUNDP also strengthens justice, security, and rule of law through (i) the implementation of the justice reform national policy and the police reform action plan, as well as the fight against impunity of international crimes, especially within the framework of the drawdown of the United Nations Organization Stabilization Mission in the DR Congo (MONUSCO); (ii) the implementation of national strategies and plans against sexual and gender-based violence; and (iii) the improvement of the strategic, legal and institutional anti-corruption frameworks, in addition to the design and implementation of an effective national action plan.

In view of the high demands posed on UNDP in the DRC in critical programming areas, the CO needed to expand its presence throughout the country, especially in areas where post conflict transitional recovery, coordination and action are a priority. The expansion of UNDP presence in the various provinces is set against a background of difficult geographical access, logistics and communications challenges, security constraints, etc.

In 2020, to uphold the principle of leaving no one behind, UNDP in the DRC targeted the disadvantaged (poor, youth, women, displaced and/or returned populations, indigenous people, and people with disabilities) in the most fragile and conflict-affected regions especially the Grand Kasai, north-eastern and south-eastern regions, as well as the provinces affected by the Ebola outbreak.

In collaboration with the Government of the Democratic Republic of Congo (DRC), – UNDP DRC is implementing, the Local Development Programme of the 145 territories (PDL-145T) aimed at reducing spatial inequalities and transforming the conditions and living environments of Congolese populations living in rural territories hitherto poor. This national programme is consisting of 9 provinces with 54 territories. The overall cost of the PDL-145T part entrusted to UNDP is estimated at USD 610,690,541 (out of a total of USD 1.66 billion). As one of the implementing agencies of the PDL-145T, UNDP has established a dedicated Support Programme to cover the Programme under his responsibility.

The country office decided to undergo a review of its office structures through a comprehensive stream analysis, including for its local presences. This review exercise results in a rationalization of its local presences for more efficiency. Specific management arrangements are also established to provide oversight of results and financial accountability at all levels of implementation of its program including in local presences. The Goma Sub-office supervises, coordinates, and leads UNDP works in the East provinces of North and South Kivu and Ituri, including Tshopo, Bas Uele and Haut Uele, thus, its plays a key representational role for UNDP and providing operational support to several project offices based in the East.

DUTIES & RESPONSIBILITIES

Under the overall guidance of the Resident Representative, and direct supervision of DRRs, the Head of Office oversees the day-to-day Programme and Operations activities at the sub office level.  The main role is to lead office management, ensure consistent services delivery and provide analysis of administrative service requirements to support programme delivery.

The Head of Sub Office leads and manage the Goma Sub office and supervises the UNDP Local Presences of South Kivu and Ituri. He/she leads and guides Team and fosters collaboration within the team, with programme and operations staff and with other UN Agencies and a client-oriented approach. He/She works in close collaboration with programme and project teams in the CO, operations staff in other UN Agencies, UNDP HQs staff and Government officials to successfully deliver services.

Key duties and accountabilities include:

Ensure Direction and coordination of Sub-Office administrative areas, coordination of financial operations, procurement and logistical service, Information and communication management and supervision of the teams focusing on achievement of the following results:

  • Under the guidance of DRR/Operations, Full compliance of operations with UN/UNDP rules, regulations and policies, implementation of corporate operational strategies.
  • Establishment of collaboration arrangements with potential partners.
  • Analysis of administrative service requirements to support programme delivery.
  • Ensures effective coordination of financial operations at the Sub office level.
  • Ensures coordination of efficient procurement and logistical services, proper management of UNDP assets, facilities and logistical services at the Sub office level.
  • Ensures forward-looking information and communication management at the Sub office level.
  • Ensures the smooth running of Sub Office including good management and supervision of staff, finance and administrative matters in accordance with relevant UNDP rules and procedures.

Ensure Representation and Coordination focusing on achievement of the following results:

  • Under guidance of the Resident Representative, represents UNDP in the geographic area and provides the orientation of the UNDP at local level and supervises all activities of the sub-office.
  • Provides strong coordination support to UN Agencies, Non-Governmental Organizations (NGOs) and national authorities through the establishment of a wider consultation process and appropriate fora to enhance coordination between humanitarian and transition-to-development partners, thus strengthening the links between relief, early recovery and development activities.

  • Under the guidance of DRR/Programme and in close collaboration with the relevant Programme units at the Country Office level, is responsible for the implementation of the CO strategic direction and oversight and quality control of programme
  • Advises the Country Office, national counterparts and other aid partners on policies and strategies to adequately respond to transitional recovery and development challenges and needs.
  • Ensures identification and promotion of joint programming and planning opportunities.
  • Coordinates with MONUSCO and UN Agencies at local level.
  • Based on monitoring and evaluation of the recovery and development situation, provides programmatic responses to the deficits in this area.
  • Promotes identification and synthesis of best practices and lessons learned for organizational sharing and learning.

Ensure Programme Oversight, Quality Control and Assurance focusing on achievement of the following results:

  • Under the guidance of DRR/Programme, ensures proper implementation of programmes based on continuous monitoring and analysis of (a) the most critical recovery and development needs, response capacities, access situation, operational environment and applicable security issues and (b) implementation progress of the programmes in his/her geographic area.
  • Leads the UNDP programme and facilitates attainment of expected results in his/her geographic area in close collaboration with the DRR/Programme;
  • Ensures effective application of RBM tools, monitors field office and project unit work plans, programme effectiveness and achievement of results.

  • Experience in international organization and familiarity with UNDP management system is highly desirable
  • Knowledge of and exposure to a wide range of humanitarian assistance, emergency relief, human rights and development-related issues.
  • Analytical capacity, including the ability to analyze and articulate recovery and development dimensions and related issues that require a coordinated UN response.
  • Good knowledge of the country and region of assignment, including the political, economic and social dimensions. Ability to work under extreme pressure in a highly stressful environment.
  • Knowledge of institutional mandates, policies and guidelines pertaining to recovery and development issues and sound knowledge of the institutions of the UN system.
  • Experience in the usage of computers and office software packages (MS Word, Excel, etc).

Language Requirement:
